The current study is a pilot trial to examine the effects of a nonelective, classroom-based, teacher-implemented, mindfulness meditation intervention on standard clinical measures of mental health and affect in middle school children. A total of 101 healthy sixth-grade students (55 boys, 46 girls) were randomized to either an Asian history course with daily mindfulness meditation practice (intervention group) or an African history course with a matched experiential activity (active control group). Self-reported measures included the Youth Self Report (YSR), a modified (...) Spielberger State-Trait Anxiety Inventory, and the Cognitive and Affective Mindfulness Measure –Revised. Both groups decreased significantly on clinical syndrome subscales and affect but did not differ in the extent of their improvements. Meditators were significantly less likely to develop suicidal ideation or thoughts of self-harm than controls. These results suggest that mindfulness training may yield both unique and non-specific benefits that are shared by other novel activities. (shrink)

An underexamined insight of W. E. B. Du Bois’s John Brown is that John Brown worked for much of his life to cultivate democratic relationships with the Black Americans with and for whom he worked. Brown did so through practicing deference and deliberation, and by seeking authorization. However, Brown’s commitment to these practices faltered at a crucial moment in decision making: when he raided Harpers Ferry absent widespread support. Examining this aspect of John Brown brings into relief an overlooked tragic (...) choice Brown made: To act in accordance with his own substantive vision of what justice required, Brown eschewed democratic ideals and practices that grounded the distinctive relations of equality he had cultivated with the Black communities with and for whom he worked. Metaphors for describing the introduction, impacts, and management of non-native species are numerous and often quite outspoken. Policy-makers have adopted increasingly disputed metaphorical terms from scientific discourse. We performed a critical analysis of the use of strong metaphors in reporting scientific findings to policy-makers. Our analysis shows that perceptions of harm, invasiveness or nativeness are dynamic and inevitably display multiple narratives in science, policy or management. Improving our awareness of multiple expert and stakeholder narratives that exist in the context of (...) non-native species management, as well as metaphorical alternatives, is critical. (shrink)

This paper provides a retrospective and prospective overview of TU Delft’s approach to engineering ethics education. For over twenty years, the Ethics and Philosophy of Technology Section at TU Delft has been at the forefront of engineering ethics education, offering education to a wide range of engineering and design students. The approach developed at TU Delft is deeply informed by the research of the Section, which is centered around Responsible Research and Innovation, Design for Values, and Risk Ethics. These theoretical (...) approaches are premised on the notion that technologies are inherently value-laden, and as such contain the possibility of fostering or hindering moral values. Each of these approaches encourages students to take a proactive attitude with respect to their projects and profession, thinking creatively about – and taking responsibility for – how to both prevent harm and do good via the technologies they help develop. To explain how this is put into practice, this paper sketches a brief history of ethics teaching at TU Delft, outlines current activities, and presents future plans for Bachelor and Master’s level engineering ethics education at TU Delft. The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

Mindfulness training has been used to improve emotional wellbeing in early adolescents. However, little is known about treatment outcome moderators, or individual differences that may differentially impact responses to treatment. The current study focused on gender as a potential moderator for affective outcomes in response to school-based mindfulness training. Sixth grade students (N = 100) were randomly assigned to either the six weeks of mindfulness meditation or the active control group as part of a history class curriculum. Participants in the (...) mindfulness meditation group completed short mindfulness meditation sessions four to five times per week, in addition to didactic instruction (Asian history). The control group received matched experiential activity in addition to didactic instruction (African history) from the same teacher with no meditation component. Self-reported measures of emotional wellbeing/affect, mindfulness, and self-compassion were obtained at pre and post intervention. Meditators reported greater improvement in emotional wellbeing compared to those in the control group. Importantly, gender differences were detected, such that female meditators reported greater increases in positive affect compared to females in the control group, whereas male meditators and control males displayed equivalent gains. Uniquely among females but not males, increases in self-reported self-compassion were associated with improvements in affect. These findings support the efficacy of school-based mindfulness interventions, and interventions tailored to accommodate distinct developmental needs of female and male adolescents. (shrink)

As past studies of the association between parent-child relationship and problematic internet use show mixed results and are influenced by many factors, this meta-analysis of 75 primary Chinese and English language studies from 1990 to 2021 with 110,601 participants (aged 6−25 years) explored (a) the overall association between parent-child relationship and problematic internet use, and (b) whether the association is affected by their types, country, measures, objects of the parent-child relationship, gender, age, year and publication types. We used funnel plots, (...) Classic fail-safe N and Egger's test to test for publication bias and for moderation with the homogeneity tests. The results showed a negative association between quality of parent-child relationship and problematic internet use (r = −0.18, 95% CI = [−0.20, −0.15]). The moderation analysis found that compared with internet addiction tendency, the association between social media addiction and parent-child relationship was stronger. (shrink)

This study asserts that W.V.O. Quine’s eliminative philosophical gaze into mereological composition affects inevitably his interpretations of composition theories of ontology. To investigate Quine’s property monism from the account of modal eliminativism, I applied to his solution for the paradoxes of de re modalities’ . Because of its vital role to figure out how dispositions are encountered by Quine, it was significantly noted that the realm of de re modalities doesn’t include contingent and impossible inferences about things. Therefore, for him, (...) all the intrinsic forces and elements of entities such as powers and causal or teleological dispositions for ontology demand to be seen necessarily as bound variables from a monist perspective. Although his denial of analyticity and the elimination of dispositional field of ontology, S. Mumford criticizes the monist perspective of Quine’s paradoxical approach to superveniences. Because superveniences create problems while determining type-type identities from a monist mereological perspective. It is observed that Quine faces with a reduction again in terms of his dispositional monism despite his critiques to repulse vagueness from the ontology in his well-known article Two Dogmas of Empiricism. -/- . Smarandache in 2019 has generalized the algebraic structures to NeutroAlgebraic structures and AntiAlgebraic structures. In this paper, authors, for the first time, define the NeutroAlgebra of neutrosophic triplets group under usual+ and x, built using {Zn, x}, n a composite number, 5 < n < oo, which are not partial algebras. As idempotents in Zn alone are neutrals that contribute to neutrosophic triplets groups, we analyze them and build NeutroAlgebra of idempotents under usual + and x, which are not partial (...) algebras. We prove in this paper the existence theorem for NeutroAlgebra of neutrosophic triplet groups. This proves the neutrals assocaited with neutrosophic triplet groups in { Zn, X} under product is a NeutroAlgebra of triplets. We also prove the non-existence theorem of NeutroAlgebra for neutrosophic triplets in case of Zn when n = 2p, 3p and 4p (for some primes p). Several open problems are proposed. With a diverse sample (N = 231 paired responses) of employees from various organizations in Pakistan, the authors tested for the main effects of perceived organizational politics and psychological capital on turnover intentions, job satisfaction, and supervisor-rated job performance. They also examined the moderating influence of psychological capital in the politics–outcomes relationships. Results provided good support for the proposed hypotheses. While perceived organizational politics was associated with all outcomes, psychological capital had a significant relationship with job satisfaction and supervisor-rated performance (...) only. As hypothesized, the negative relationship of perceived organizational politics with job satisfaction and supervisor-rated performance was weaker when psychological capital was high. “Substance-in-relation” is W. Norris CLARKE’s own contribution to the thought of Aquinas on the metaphysics of the human person. Clarke argues that a dynamic notion of the human person with an intrinsic dynamic substance and a primordial relation is implicit in the thought of Aquinas and he wants to make them explicit. His approach was to “creatively retrieve” this intrinsic dynamic notion in Aquinas and to “complete” it with the rich relational notion that was well-developed by some contemporary existential phenomenologists, (...) personalists and psychotherapists. He argues that the human person possesses dyadic structures of substance and relation that are equally primordial. So, for him, “to be” a human person is to be a “substance-in-relation.” This implies that substance alone, even though dynamic, is insufficient to constitute a human person. In this way, Clarke seems to differ from Aquinas who argued that the human person is a substance composed of body and soul. In fact, the conclusions reached by Clarke on the basic seminal ideas of the human person leaned more towards the thoughts of the above contemporary thinkers than that of Aquinas, suggesting that he must have departed significantly from St. Thomas. This raises doubt about to what extent he retrieved the thought of Aquinas. This research, therefore, is an attempt to furnish some elements that would help the reader to evaluate whether Clarke’s work could be considered more as a “creative retrieval” or more as a “creative completion” of the thought of Aquinas. The method employed here is to trace the background to the formation of Clarke’s thought. There is also an analysis of his thought. This is followed by a critical analysis of his notion of human substance and of relation. Finally, certain elements are furnished to help the reader in this evaluation. (shrink)

Bayle's arguments for degrees of evidence, as well as for the necessity and sufficiency of possessing a high degree of evidence in order to form virtuous beliefs, are surveyed as well.

There is no uniquely standard concept of an effectively decidable set of real numbers or real n-tuples. Here we consider three notions: decidability up to measure zero [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382], which we abbreviate d.m.z.; recursive approximability [or r.a.; K.-I. Ko, Complexity Theory of Real Functions, Birkhäuser, Boston, 1991]; and decidability ignoring boundaries [d.i.b.; W.C. Myrvold, The decision problem for entanglement, in: R.S. (...) Cohen et al. (Eds.), Potentiality, Entanglement, and Passion-at-a-Distance: Quantum Mechanical Studies fo Abner Shimony, Vol. 2, Kluwer Academic Publishers, Great Britain, 1997, pp. 177–190]. Unlike some others in the literature, these notions apply not only to certain nice sets, but to general sets in Rn and other appropriate spaces. We consider some motivations for these concepts and the logical relations between them. It has been argued that d.m.z. is especially appropriate for physical applications, and on Rn with the standard measure, it is strictly stronger than r.a. [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382]. Here we show that this is the only implication that holds among our three decidabilities in that setting. Under arbitrary measures, even this implication fails. Legal systems often rule that people own objects in their territory. We propose that an early-developing ability to make territory-based inferences of ownership helps children address informational demands presented by ownership. Across 6 experiments (N = 504), we show that these inferences develop between ages 3 and 5 and stem from two aspects of the psychology of ownership. First, we find that a basic ability to infer that people own objects in their territory is already present at age 3 (Experiment (...) 1). Children even make these inferences when the territory owner unintentionally acquired the objects and was unaware of them (Experiments 2 and 3). Second, we find that between ages 3 and 5, children come to consider past events in these judgments. They move from solely considering the current location of an object in territory-based inferences, to also considering and possibly inferring where it originated (Experiments 4 to 6). Together, these findings suggest that territory-based inferences of ownership are unlikely to be constructions of the law. Instead, they may reflect basic intuitions about ownership that operate from early in development. (shrink)

O exame ultrassonográfico é uma ferramenta diagnóstica de grande relevância na rotina veterinária, uma vez que, apresenta ampla difusão entre os atendimentos de animais e permite a avaliação de órgãos e estruturas de forma não invasiva, segura e rápida, auxiliando na determinação de diversas afecções, levando ao tratamento adequado e contribuindo de forma positiva no prognóstico do paciente. Atualmente, em muitos casos, a avaliação testicular não faz parte da rotina ultrassonográfica em exames de ênfase abdominal, devido à sua localização anatômica (...) no escroto, podendo assim levar ao diagnóstico limitado e ao tratamento inadequado do paciente quando na ausência da avaliação dos testículos, posto que diversas são as afecções testiculares que podem acometer cães e que apresentam características ultrassonográficas de fácil detecção. Dentre as principais alterações observadas por meio da ultrassonografia, os casos de orquite, criptorquidismo, torção e também neoformações neoplásicas testiculares correspondem à maior casuística, sendo o método ultrassonográfico um exame com 98% a 100% de sensibilidade e acurácia para diagnóstico destas. Dessa forma, o objetivo deste artigo de revisão bibliográfica é elucidar a importância da avaliação testicular em exames ultrassonográficos de rotina, discorrendo inicialmente sobre os aspectos anatômicos e ultrassonográficos, e posteriormente acerca das afecções mais comumente diagnosticadas na rotina veterinária, apresentando ainda as alterações ultrassonográficas causadas no parênquima testicular. Ultrassonografia. -/- THE IMPORTANCE OF INCLUDING TESTICULAR ASSESSMENT IN THE TWO-DIMENSIONAL ABDOMINAL ULTRASOUND ROUTINE IN DOGS FOR THE DIAGNOSIS OF TESTICULAR DISEASES ABSTRACT: The ultrasound examination is a diagnostic tool of great relevance in the veterinary routine, as it is widespread in the current reality and allows the assessment of organs and structures in a non-invasive, safe and fast way, helping in the diagnosis of various conditions, leading to adequate treatment and positively contributing to the patient’s prognosis. Currently, in many cases, testicular evaluation is not part of the ultrasound evaluation in exams with abdominal emphasis, due to its anatomical location in the scrotum, which can lead to limited diagnosis and inadequate treatment of the patient in the absence of ultrasound evaluation of the testicles, since there are several testicular affections that can affect dogs and that present ultrasonographic characteristics that are easily detected. Among the main alterations observed during ultrasonographic exams, cases of orchitis, cryptorchidism, torsion and also testicular neoplastic neoformations correspond to the largest sample, with the ultrasonographic method being an exam with 98% to 100% sensitivity and accuracy for their diagnosis. Thus, the aim of this literature review article is to elucidate the importance of testicular evaluation in routine ultrasound examinations, initially discussing the anatomical and ultrasound aspects, and later on the most commonly diagnosed conditions in the veterinary routine, also presenting the ultrasound changes caused in the testicular parenchyma. Precision Medicine is driven by the idea that the rapidly increasing range of relatively cheap and efficient self-tracking devices make it feasible to collect multiple kinds of phenotypic data. Advocates of N = 1 research emphasize the countless opportunities personal data provide for optimizing individual health. At the same time, using biomarker data for lifestyle interventions has shown to entail complex challenges. In this paper, we argue that researchers in the field of precision medicine need to address the performative dimension (...) of collecting data. We propose the fun-house mirror as a metaphor for the use of personal health data; each health data source yields a particular type of image that can be regarded as a ‘data mirror’ that is by definition specific and skewed. In my paper, which Brown cites, I argue that, just as it is ethically acceptable for (...) parents to allow their children and themselves to be immunized using vaccines produced by cell lines derived from human fetuses aborted in the past, it is also acceptable for persons in the future to benefit from treatments that use iPS cells validated using human embryonic stem (ES) cell lines [End Page 202] derived in the past. The assumption I make is that iPS cells would have to be shown to be functionally equivalent to human ES cells—i.e., validated—before they could be used for cell replacement treatments. (If it turns out that this assumption is incorrect, and primate or even mouse ES cells can be used for the validation, then all residual ethical problems will disappear and there will be no ethical problems whatsoever associated with iPS cells.) I wrote:... [I]n both cases, the origin of the treatment is in a one-time event: either the one-time use of aborted fetuses to obtain cell lines (e.g., MRC-5 and WI- 38) to grow weakened virus strains for vaccine production, or the one-time destruction of human embryos to validate iPS cells, which then effectively replace embryonic stem cells. In the latter case, if no additional embryonic stem cell lines are derived, then derivation of the existing lines could be considered a “one-time” event in the past, albeit an event that extended over a several-year period(Byrnes 2008, p. 287, emphasis added).Note the phrase “if no additional embryonic stem cell lines are derived.” The derivation of ES cell lines inherently involves destruction of embryos; indeed, that is why many people, including me, are opposed to human ES cell research. In my article, I am arguing that, if no additional ES cell lines are derived, then no additional human embryos will be destroyed, and the destruction of human embryos will lie in the past. In this case, embryo destruction could be considered a past event, just as the abortion of a human fetus from which vaccine-producing cell lines were derived is a past, albeit tragic, event.In the process of building his argument that proponents of iPS cell research are morally complicit in embryo destruction, Brown (2009, p. 15) casts me as being in favor of the “derivation of new embryonic stem [cell lines].” This is the exact opposite of my position. In fact, I am opposed to further destruction of human embryos. I believe that the hundreds of ES cell lines already in existence are more than sufficient to validate iPS cells and so no additional lines need to be derived. This means that no additional human embryos will need to be destroyed.Apparently based on the misperception that I support future destruction of human embryos, Brown concludes that “Byrnes’s endorsement of ongoing iPSC validation studies would seem to implicate him and those who follow his lead in formal and material complicity in what they perceive as moral evil” (p. 16). He writes that “explicit formal complicity would attach because he [Byrnes] knowingly and intentionally recommends that embryos be killed in order to facilitate a transition to a future in which no more embryos need be destroyed” (p. 16). Additionally, my “followers” and I would be guilty of “proximate material complicity” as well as “remote material complicity” (p. 16). To the uninitiated, this may look like the same old Ireland; in fact, it may not even look like news. Certainly, it is not quick change [...]. But if we unpack this simple statement, we find that there is much that is new here, and (...) much that is of interest to those who might want to approach things Irish from a legal perspective. Indeed, approaching Ireland from a legal perspective may be precisely what is new. While our research has found much discussion of the social, political and historical aspects of Irish culture, there is not much that would both qualify as legal scholarship and is up-to-date in a situation that experiences significant changes daily. Public discourse is often caustic and conflict-filled. This trend seems to be particularly evident when the content of such discourse is around moral issues (broadly defined) and when the discourse occurs on social media. Several explanatory mechanisms for such conflict have been explored in recent psychological and social-science literatures. The present work sought to examine a potentially novel explanatory mechanism defined in philosophical literature: Moral Grandstanding. According to philosophical accounts, Moral Grandstanding is the use of moral talk to seek social (...) status. For the present work, we conducted six studies, using two undergraduate samples (Study 1, N = 361; Study 2, N = 356); a sample matched to U.S. norms for age, gender, race, income, Census region (Study 3, N = 1,063); a YouGov sample matched to U.S. demographic norms (Study 4, N = 2,000); and a brief, one-month longitudinal study of Mechanical Turk workers in the U.S. (Study 5, Baseline N = 499, follow-up n = 296), and a large, one-week YouGov sample matched to U.S. demographic norms (Baseline N = 2,519, follow-up n = 1,776). Across studies, we found initial support for the validity of Moral Grandstanding as a construct. Specifically, moral grandstanding motivation was associated with status-seeking personality traits, as well as greater political and moral conflict in daily life. (shrink)

Kant scholars have rarely addressed the notion of optimism as it was interpreted by the Königsbergian philosopher in the mid-18th century. The notion originates from Leibniz’s Theodi­cy and from debates over whether the actual world is the best of all possible worlds. The first of a two-part series, this article studies the historical context in which appeared Kant’s 1759 lecture advertisement leaflet entitled An Attempt at Some Reflections on Optimism. The study describes the requirements of the 1755 Berlin Academy of (...) Sciences’ competition for a comparison of G. W. Leibniz’s and A. Pope’s systems and an assessment of optimism. Another focus is the philological difficulties of translating Pope’s proposition “Whatever is, is right” into the French language — which was part of the competition task. The author considers the ways the proposition was translated into the Russian and German languages. The article shows the contribution of Voltaire and his Poem on the Lisbon Disaster and Candide: or, Optimism to the post factum changes in the perception of the competition results and to the emergence of new shades of meaning in the concept of optimism. The Lisbon earthquake of 1755 had a profound effect on Europe and on the perception of optimism and of the idea that the actual world is the best of all possible worlds. However, Kant’s epistolary legacy leads one to the conclusion that the philosopher examined the problem in the framework of a polemic on Crusian philosophy. This article presents Crusius’s arguments against the theory that this is the best of all possible worlds and in favour of the theory that there are several good worlds. God’s choice of the actual world owes therefore to the freedom of contradiction (libertas contradictionis) and to the freedom of contrariety (libertas contrarietatis), which are eliminated in the teaching of optimism. Audience segmentation is necessary in health communications to ensure equitable resource distribution. Peer crowds, which are macro-level teen subcultures, are effective psychographic segments for health communications because each crowd has unique mindsets, values, norms, and health behavior profiles. These mindsets affect behaviors, and can be used to develop targeted health communication campaigns to reach those in greatest need. Though peer crowd research is plentiful, no existing peer crowd measurement tool has been formally validated. As such, we developed and validated Virginia's (...) Mindset Lens Survey (V-MLS), a mindset-based teen peer crowd segmentation survey to support health communication efforts. Using an online convenience sample of teens (N = 1,113), we assessed convergent and discriminant validity by comparing the V-MLS against an existing, widely-used peer crowd survey (I-Base Survey®) utilizing a multi-trait multi-method matrix. This interview, conducted over the span of several months, tracks the respective journeys of Constantin V. Boundas and Daniel W. Smith with the philosophy of Gilles Deleuze. Rather than “becoming Deleuzian,” which is neither desirable nor possible, these exchanges reflect an array of encounters with Deleuze. These include the initial discoveries of Deleuze’s writings by Boundas and Smith, in-person meetings between Boundas and Deleuze, and the wide-ranging and influential philosophical work on Deleuze’s concepts produced by both Boundas and Smith. At (...) stake in this discussion are key contributions by Deleuze to continental philosophy, including the distinction between the virtual and the actual and the very nature of a “concept.” Also at stake is the formative or pedagogical impact of a philosopher, like Deleuze, on those who find and fully engage with his texts, concepts, and project. The paper by Monteiro, Musten and Compson (2014) is to be commended for providing a comprehensive discussion of the compatibility issues arising from the integration of mindfulness – a 2,500-year-old Buddhist practice – into research and applied psychological domains. Consistent with the observations of various others (e.g., Dunne, 2011; Kang & Whittingham, 2010), Monteiro and colleagues have not only highlighted that there are differences in how Buddhism and contemporary mindfulness interventional approaches interpret and contextualize mindfulness, but there are also differing (...) interpretations of mindfulness within Buddhism. These apparent differences within Buddhism are arguably more noticeable when making comparisons across Buddhist vehicles (i.e., Theravada, Mahayana, Vajrayana), but to a lesser extent intra-vehicular differences can also be said to exist (i.e., differences between Buddhist traditions of the same vehicle). This commentary investigates the validity of some of these different Buddhist constructions of mindfulness, and then discusses how a better understanding of their scriptural and conceptual soundness (or lack thereof) may help to reconcile some of the actual and perceived incompatibility between Buddhist practice and contemporary secular mindfulness-based approaches. The philosophical model of constellation has been applied to contemporary musical form, but it reveals too many limitations when confronted with late Adorno’s model of informal music. Once the component of heteronomy, in hierarchical and centered structures of traditional music, has been overcome, it reemerges in the opposite type, the decentered, non-hierarchical or free structures, between the opposites of serialism and aleatoric music. Therefore, the model of informal music, as an "image of freedom", pursues the realization of a musical-aesthetic nominalism (...) that is subtracted from all forms of heteronomy, ancient or modern. To do this, it has to achieve the 'actually constructed totality' of the work, integrating in it the opposite of free subjectivity. (shrink)

“Il n’y a pas de hors-texte”. Intralinguistic Semantics and Its Philosophical and Cognitive Consequences The aim of this paper is to present and metatheoretically analyse the model of intralinguistic semantics as set forth by Umberto Eco in his Theory of Semiotics. The distinctive feature of this system is the rejection of the realistic category of reference, understood as a correspondence of meaningful units with the extralinguistic domain of interpretation, i.e., with a class of extralinguistic semantic correlates. As a result, the (...) main idea of Eco’s theory is to replace the traditional extralinguistic semantics with the new one, in which the meaning of each unit is determined solely by its relations with the other elements of the system. Language formed in this way is semantically autonomous, intralinguistically closed and self-explaining. Analysis of Eco’s theory by means of the appropriate conceptual apparatus reveals the far-reaching philosophical and cognitive implications of his approach in studies on language, meaning and truth. The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Analizy przebiegają od zagadnienia antropologicznych podstaw sprawiedliwości poprzez problematykę działań realizujących sprawiedliwość do zagadnienia sprawiedliwości prawa stanowionego. Opracowanie zamykają uwagi wskazujące na kontekst teologiczny istotny dla problematyki sprawiedliwości, którego analiza wykracza jednak poza podjęte zamierzenie koncentrujące się na problematyce filozoficznoprawnej. Argumentuje się, że u podstaw tej refleksji leży namysł nad relacją człowieka do dobra, która stanowi ontologiczną podstawę prawa naturalnego i sprawiedliwości – nakazy i zakazy są wtórne wobec tej relacji. Celem prawa i sprawiedliwości jest dobro konkretnego, obdarzonego godnością człowieka, a nie np. przywracanie abstrakcyjnie pojętego porządku moralnego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. O presente artigo pretende precisamente revisar a natureza iusfundamental do consentimento informado a partir da obra de W.N. Hohfeld e Robert Alexy. (shrink)

Objectives. The purpose of this study was to conduct the first randomized controlled trial (RCT) to evaluate the effectiveness of a second-generation mindfulness-based intervention (SG-MBI) for treating fibromyalgia syndrome (FMS). Compared to first generation mindfulness-based interventions, SG-MBIs are more acknowledging of the spiritual aspect of mindfulness. Design. A RCT employing intent-to-treat analysis. Methods. Adults with FMS received an 8-week SG-MBI known as meditation awareness training (MAT; n = 74) or an active control intervention known as cognitive behaviour theory for groups (...) (n = 74). Assessments were performed at pre-, post-, and 6-month follow-up phases. Results. Meditation awareness training participants demonstrated significant and sustained improvements over control group participants in FMS symptomatology, pain perception, sleep quality, psychological distress, non-attachment (to self, symptoms, and environment), and civic engagement. A mediation analysis found that (1) civic engagement partially mediated treatment effects for all outcome variables, (2) non-attachment partially mediated treatment effects for psychological distress and sleep quality, and (3) non-attachment almost fully mediated treatment effects for FMS symptomatology and pain perception. Average daily time spent in meditation was found to be a significant predictor of changes in all outcome variables. Conclusions. Meditation awareness training may be a suitable treatment for adults with FMS and appears to ameliorate FMS symptomatology and pain perception by reducing attachment to self. (shrink)

Legal philosophers and property scholars sometimes disagree over one or more of the following: the meaning of the word 'property,' the concept of property, and the nature of property. For much of the twentieth century, the work of W.N. Hohfeld and Tony Honoré represented a consensus around property. The consensus often went under the heading of property as bundle of rights, or more accurately as a set of normative relations between persons with respect to things. But by the mid-l 990s, (...) the consensus was under attack. Key figures in the attack were James Penner, a legal philosopher, and Thomas W. Merrill and Henry E. Smith, two highly regarded professors of property law. This article aims to repel the attack and argues for property as a set of normative relations between persons with respect to things. The positive case for this view of property pays special attention to the philosophy of language and the analysis of concepts. The positive case also maintains that the right to use and the power to transfer are as central to property as the right to exclude. It is possible that the virtues of Smith's modular theory of property differ from the virtues of a well-crafted bundle theory. Indeed, it may be the case that these two theories throw light on different features of property law and are not, save at the margin, competitors with each other. The label 'new essentialism' sometimes applied to the work of Penner, Merrill, and Smith seems inapt if property does not have an essence. Of course, they might refuse the label. (shrink)

n Part I of this essay I take a canonical case of political theology, Schmitt’s theory of sovereignty (1985; 1922), and show how Agamben derives his account of sovereignty from an interpretation of Schmitt that relies on the interesting theological premise of an atemporal act or decision, one that is traditionally attributed to god’s act of creation, and that is only ambiguously secularized in the transcendental moment of German Idealism. In Part II I show how this reading of Schmitt can (...) be used to avoid a certain kind of negative political theology associated with deconstruction because Agamben’s reading of Schmitt explains the emergence of certain specific temporal structures associated with the sovereign political decision: the sovereign political decision cannot be represented as having a beginning, and hence recedes phenomenologically into a kind of a priori past; and the sovereign decision cannot be represented as completed, and hence it is experienced as a ‘perpetual expenditure of energy’ that lacks comprehensible relation to a goal. In Part III I defend Agamben’s interpretation of sovereignty as a transcendental act from Negri’s objection that Agamben simply equates without argument Negri’s radically democratic conception of revolutionary constituent power with Schmitt’s conception of sovereignty (1999, p. 13). My defense relies on identifying Agamben’s ‘paradox of sovereignty’ (Agamben 1998, pp. 15ff.) with a ‘paradox of democracy.’ (Mouffe 2000; Whelan 1983) In Part IV I realize a corollary of the identification of the two paradoxes, of sovereignty and democracy: that political borders are the spatial site of the application of the act of political sovereignty, and possess a kind of transcendental spatiality akin to the special temporality associated with sovereignty. I apply this understanding to the privileged special case of the US-Mexico border: the structures implicit in Agamben’s analysis explain some crucial features of this case of walling: its manifest failure to achieve, even in principle, the purpose for which it is allegedly intended; the failure of democratic polity to address those affected by the wall; the appeal to sovereign powers in the legal legitimation of border policy. I defend Agamben’s analysis against other apparently competing views, especially those of Wendy Brown (2010) and argue that the transcendental act of sovereignty comprises a kind of primary political repression that opens up the space for ideological understandings of the wall, but does not itself comprise one. In Part V I address the question whether Agamben’s derived category of ‘bare life’ can also be used in the context of the border, arguing that it can. I conclude with some critical remarks about the limits of Agamben’s view. (shrink)

Concebir los derechos como una protección no-paternalista de los intereses de sus titulares supone aceptar que su aspecto más relevante consiste en la provisión de una competencia para renunciar o consentir su inobservancia por terceros, lo cual no tiene por qué coincidir con la mejor estimación de sus intereses, aun cuando estos últimos juegan un papel importante en la justificación de las posiciones jurídicas implicadas. A partir de la tesis de la correlatividad, los conceptos jurídicos fundamentales de W.N. Hohfeld y (...) una tesis de la combinación que armoniza los elementos de la voluntad e interés en la explicación de los derechos, en el presente artículo se tratará de mostrar por qué afirmar el carácter inalienable de los derechos contradice la función que estos desempeñan en los ordenamientos jurídicos modernos. // The understanding of rights as non-paternalistic protections of its holder’s concerns entails that the most important aspect of them is the provision of a power either to waive or to consent their encroachment by others, which does not necessarily coincide with the best appraisal of his/her interests, even when they play an important role in the justification of the subjective legal positions. From the correlativity thesis, the fundamental legal conceptions devised by W.N. Hohfeld and a combination thesis that merges the elements of will and interest in the explanation of rights, I will try to show why to stand up for the inalienable character of rights contradicts the function they perform in modern legal systems. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. Questo breve volume prende in considerazione, analizza e commenta alcune interpretazioni magistrali della filosofia di Giordano Bruno, che hanno attraversato l'800 ed il '900, indirizzandone l'orizzonte di comprensione. Il testo inizia con l'interpretazione di G.W.F. Hegel e di B. Spaventa, per poi accedere a quella di G. Gentile. Il volume si conclude con l'analisi ed il commento dell'interpretazione fornita da N. Badaloni. Una piccola bibliografia bruniana conclude il testo.

In this unpublished Latin fragment (which dates from May 1702) G. W. Leibniz criticizes the Cartesian conception of body and force and develops his own notion of matter, extension and his theory of forces. He argues against Descartes and Cartesians that 1) the essence of corporal bodies cannot be reduced to extension alone but the latter arise from the primitive force itself, 2) consequently Cartesian quantity of motion falls short to account the motive force of a moving body since the (...) true nature of physical bodies which can only be understood through a careful analysis of dynamical forces. -/- Mayıs 1702’de kaleme aldığı ve ölümünden sonra yayımlanan bu Latince fragmanda G. W. Leibniz, Kartezyen felsefenin cisim ve kuvvet anlayışını eleştirir ve kendi madde, uzam ve kuvvetler teorisini geliştirir. Leibniz, Descartes ve Kartezyenlere karşı 1) cisimlerin özünün yalnızca uzama indirgenemeyeceğini, bunun ilksel kuvvetin kendisinden kaynaklandığını, 2) sonuç olarak da Kartezyen hareket miktarının hareket eden bir cismin kuvvetini açıklamakta yetersiz kaldığını, çünkü fiziksel cisimlerin gerçek doğasının ancak dinamik kuvvetlerin dikkatli bir analiziyle anlaşılabileceğini ileri sürer. Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. La cuestión versa sobre la posición de los derechos de defensa en la tesis de Jellinek y si es viable su empleo en la conceptualización de los actuales derechos fundamentales. (shrink)

N. Wiener's negative definition of information is well known: it states what information is not. According to this definition, it is neither matter nor energy. But what is it? It is shown how one can follow the lead of dialectical logic as expounded by G.W.F. Hegel in his main work -- "The Science of Logic" -- to answer this and some related questions.

Już w latach sześćdziesiątych zjawisko walencji znacznie zyskało na znaczeniu. Przyczyną tego mógł być fakt, iż gramatyka oparta na teorii walencji w coraz większym stopniu znajdowała swoje miejsce w nauczaniu języków obcych. W procesie uczenia się języka obcego istnieje bowiem zależność pomiędzy przyswajaniem znaczeń słów a zapamiętywaniem ich struktur syntaktycznych, co niewątpliwie bazuje na zjawisku walencji. Punktem wyjścia tej tezy jest zasada, według której wyrazy o podobnym znaczeniu tworzą konstrukcje o podobnej składni, co z kolei wypływa z faktu, iż wyrazy (...) bliskoznaczne wykazują podobne cechy walencyjne. Problem pojawia się podczas przyswajania języka obcego, albowiem język ojczysty w większym lub mniejszym stopniu wpływa na proces uczenia się. Chodzi tu oczywiście o zjawiska: transferu (pozytywnego oddziaływania języka ojczystego na język obcy) oraz interferencji (negatywnego wpływu), z czego zjawisko interferencji zaistniałe poprzez przenoszenie konstrukcji języka ojczystego na konstrukcje w języku obcym prowadzi do tego, że uczący się popełniają błędy. Biorąc pod uwagę sposób przedstawiania składni i konstrukcji językowych w oparciu o teorię walencji, nie da się zaprzeczyć, iż wzrasta zapotrzebowanie na informacje o cechach walencyjnych głównych części mowy (czasowników, rzeczowników oraz przymiotników). Językoznawcy starają się wyjść temu naprzeciw i redagują słowniki walencyjne, w których oprócz takich właśnie informacji zawierane są również modele poprawnych konstrukcji zdaniowych z danym słowem. W Niemczech od połowy XX w. istnieją dwa instytuty, gdzie prowadzone są badania nad zjawiskiem walencji poszczególnych części mowy: das Herder-Institut der Universität Leipzig oraz das Institut für deutsche Sprache Mannheim. W prezentowanym artykule przedstawione zostały słowniki zredagowane przez językoznawców działających w tych instytutach, jak również inne koncepcje słowników walencyjnych. Na uwagę zasługują tu przede wszystkim prace kontrastywne, jak np. opisany w artykule Słownik walencyjny niemieckich i polskich czasowników (N. Morciniec, L. Cirko i R. Ziobro). Analizie poddane zostały każdorazowo: budowa słownika, informacje zawarte przy poszczególnych hasłach, adresat, założenia oraz praktyczność danej pozycji. (shrink)
